The Clerk then read the letters connected with the business, and also the feu-charter of the Board for the ground upon which the school at Armadale is built. From these it appeared that noticce was given by the Uphall Oil Company in April last that they were about to work out the mineral underneath the school, and intimation was made that if the Board wished the mineral to remain unworked they would have to come to terms with the Company.

ACTION AGAINST THE UPHALL OIL COMPANY.
William Hamilton, innkeeper, Whitburn, the pursuer of this action, is in right of a certain piece of ground and building thereon, in the neighbourhood of the village of Armadale, and he sues the Uphall Oil Company for £800 as damages, on the ground that they have removed the minerals from the said lands without having provided adequate support for the surface and houses and buildings thereon. The defenders deny that any damage has been sustained by the pursuer through their operations, and they plead that their operations having been conducted properly and with all due care, they are not liable in reparation. Lord Adam closed the record this morning, and ordered proof.
