This agreement and lease entered into between The North British Railway Company incorporated by act of parliament, hereinafter called "the company" on the one part and The Pumpherston oil company limited incorporated under the companies act 1862 to 1900 herein after called "the oil company" on the other part witness as follows videlicit:- . . .
First
Description of ground
. . . The company shall in consideration of the sum of Twenty five pounds to be paid to them annually as hereinafter specified by the oil company (a) lease and hereby lease to the oil company all and whole the lands at the Barracks mineral depot of the company and to the south and west of Hunter street Glasgow, and (b) make and maintain at their cost a siding thereto from their said depot as such lands are delineated and coloured blue and such siding is delineated and coloured red on the plan annexed and subscribed as relative hereto. . . .
Second
Duration
. . . This agreement and lease shall endure for a period of ten tears from the date hereof unless the company require the said lands and siding for railway purposes in which case they shall be entitled to terminate the same at any time on giving to the oil company or their successors twelve months previous notice in writing of their intention to so terminate and that without being liable in any compensation. . . .
Breaks
. . . The oil company shall also be entitled to terminate this agreement at any time during the currency hereof on giving to the company twelve months previous notice in writing. . . .
Third
. . . This agreement shall not be assigned or sublet without the consent in writing of the company previously obtained and if assigned with such consent the whole clauses and provisions in it contained shall apply to the assignee. . . .
Fourth
. . . The lands let shall be used for the construction of stores thereon and for no other purpose; the plans of such stores shall be submitted to the company for approval previously to work being commenced; and the oil company shall obtain any licenses necessary to enable them to use the stores for the storage of oils, petroleum or other substances whatever for the storage of which a license is required. . . .
Fifth
. . . The oil company shall conduct all their operations upon and use the lands hereby let and stores thereon and said siding so as not to cause any damage to the company's railway undertaking or the traffic thereof: And if the oil company shall do in the contrary they shall be liable to and free and relieve the company of all damage and expense which may be incurred thereby. . . .
Sixth
Rent £25 per annum
. . . In the event of the oil company or their successors not paying any portion of the said sum of Twenty five pounds, which shall be payable half yearly at Whitsunday and Martinmas in each year in equal portions, within twentyone days after it becomes due or failing to implement or contravening any condition or provision hereof this lease and agreement shall become void without declaration. . . .
Seventh
Removal
. . . On the termination hereof, the oil company shall remove from the subjects let and cease to have any rights or to be interested in the said siding; In Witness whereof.
